6. Seller Documentation and Product Verification.

Documentary verification is an important element of petroleum commodity transactions. Depending on the product, terminal, transaction structure, and contractual requirements, sellers may be requested to provide the following documentation for review.

A. Fresh SGS Inspection Report:

A recent inspection report issued by SGS or another mutually accepted independent inspection company, where applicable. A report described as being less than 48 hours old must be confirmed against its actual issue date, inspection scope, product, location, and report reference. The report's authenticity and relevance should be independently verified.

B. ATSC — Authorization to Sell and Collect

An authorization document intended to establish the seller's authority to sell the product and collect payment. Its scope, issuing party, validity, and consistency with the underlying ownership or supply arrangements should be checked.

C. ATV — Authorization to Verify :

An authorization intended to permit specified parties to verify relevant product or transaction information. The authorized recipient, permitted verification scope, and verification channel should be confirmed directly with the issuing party.

D. Unconditional DTA and Optional Dip Test.

A DTA, as defined in the transaction documentation, may be requested to establish the agreed conditions for access, testing, or inspection. The abbreviation and its legal effect must be expressly defined in the contract.

Where appropriate, buyers may request an independent dip test or another mutually agreed inspection procedure. Such testing should be performed only with the necessary terminal or vessel authorization and under applicable safety requirements.

E. Injection Report

An injection report may be requested where relevant to document the movement or transfer of product into a designated tank or vessel. Its reliability depends on the issuing party, underlying operational records, and independent confirmation where available.

Document names alone do not establish authenticity, product ownership, physical availability, or the seller's authority to complete a transaction. Buyers should independently verify material documents through legitimate issuing organizations, inspection providers, terminal operators, or other authorized sources.

7. KYC, AML and International Trade Compliance.

Obsidian Commodity LLC places importance on Know Your Customer (KYC), Anti-Money Laundering (AML), and responsible international trading practices.

KYC and AML requirements depend on the laws and regulations applicable to the entities, financial institutions, jurisdictions, and transactions involved. Relevant checks may include:

Verification of company registration and legal identity.
Identification of beneficial owners and authorized representatives.
Review of corporate authority and seller mandates.
Screening against applicable sanctions and restricted-party lists.
Assessment of source-of-funds and source-of-product information where appropriate.
Review of the proposed transaction's commercial rationale and payment arrangements.
Verification of vessel, shipping, origin, and destination information where relevant.
Recordkeeping and escalation of suspicious or inconsistent information.

We aim to conduct transactions in accordance with applicable legal and regulatory requirements and relevant international trade practices. Under the proposed commercial arrangement, the seller pays the agreed commissions to eligible intermediaries after confirmation of the buyer's payment, in accordance with the executed commission agreement.

The documentation supplied for a transaction may include NCNDA/IMFPA agreements reported to have been notarized by a Notary Public in Houston, Texas, and Rotterdam, Netherlands, and endorsed by the seller's bank. The existence, scope, authenticity, and legal effect of any notarization or bank endorsement must be independently verified.

For clarity, notarization does not automatically establish a seller's financial capacity, guarantee commission payment, or validate the underlying commodity transaction. Similarly, a bank endorsement should not be treated as a payment guarantee unless the bank has expressly undertaken such an obligation.

Our approach is to encourage clear written agreements, appropriate verification, and transparent commission arrangements to protect the legitimate commercial interests of all authorized parties.

9. Pricing, Market Conditions and Negotiation.

Any quotation should clearly identify the product, specification, quantity, currency, pricing basis, delivery term, named port, validity period, payment conditions, and applicable additional charges.
